In the absence of regulation, last week the Orange County Board of Supervisors passed an ordinance prohibiting the sale, distribution or possession of synthetic kratom products in any form in the county. On July 1 in Kansas, kratom products will carry the same legal status and penalties as heroin and will be banned after a new law takes effect. In December, Hochul signed a bill requiring warning labels and ingredient disclosures on kratom products derived from the kratom plant. Within the industry, manufacturers of products made from the leaf regularly spar with the makers of synthetic versions like 7-OH over how kratom should be regulated. The attorney general requested a temporary restraining order and injunction preventing the companies from selling kratom products in Texas.

On June 4, Missouri Attorney General Catherine Hanaway announced that Kansas City-based CBD American Shaman — described as the largest kratom distributor in the state — agreed to immediately suspend all in-state sales of kratom and 7-OH. With the law in force, Tennessee becomes the eighth U.S. state to fully prohibit kratom, joining Alabama, Arkansas, Indiana, Rhode Island’s earlier status, Vermont, Wisconsin, and others on the restricted list.
